This project aims to study the way in which religious norms (Jewish and Muslim) adapt to the primacy of civil law in modern times (nineteenth to twenty-first centuries), in French-speaking Europe (France, Belgium, Switzerland). The aim is to analyse the ability of religious law to conform to civil law in cases where the latter contradicts the norms it enacts and the practices that result from them. When it comes to relations between the modern state and religions, both the scientific literature and the public debate have focused on the state’s self-imposed accommodation of religious law. The challenge is for the subject of law to reconcile his dual allegiance, between his submission to the law of the State and his submission to a particular religious norm. Here, the aim is the opposite: how flexible is religious law in the face of the primacy of common law? By examining a corpus of mainly legal sources (civil and religious), as well as the debates that have arisen, we will endeavour to identify the key issues where religious and civil law may find themselves in contradiction.

Duties of the position

The aim of this post-doctoral project is to produce a synthesis of: 1°) the decisions of the European Fatwa Council (mainly) and the renegotiation of their place within European countries; 2°) a map of the bodies that produce reflections on religious norms and decisions in this area; 3°) the decisions of civil courts and tribunals and the integration of the religious dimension and the religious referent into their decision-making process.

Required selection criteria

The candidate, who will be holder of a doctorate in the field of humanities and social sciences, preferably related to law, history or sociology of Muslims and Islam, will work in French. Skills: knowledge of French and English; ability to work independently; ability to read and understand Muslim jurisprudential texts.
