Título: The relationship between the eegulations on the coordination of social security systems and the Directive on the application of patients’ rights in cross-border healthcare
Resumen:Tras casi una década de aplicación de la Directiva 2011/24/UE sobre asistencia sanitaria transfronteriza, este informe vuelve a examinar algunas cuestiones pendientes en relación con la asistencia sanitaria transfronteriza en la UE, como la relación entre los Reglamentos de Coordinación de la Seguridad Social y la Directiva, el suministro de información clara y completa a los pacientes y los retos de los servicios de telemedicina transfronteriza. Aunque los instrumentos jurídicos mencionados -la Directiva y los Reglamentos- coexisten y crean un sistema complementario, las normas son a veces muy complejas y difíciles de aplicar para las instituciones y los proveedores de asistencia sanitaria y de entender para los ciudadanos. Los Reglamentos y la Directiva coinciden en cuanto al ámbito de aplicación personal y material, pero no son idénticos. Por ello, para garantizar que las personas que buscan asistencia sanitaria en el extranjero reciban asistencia sanitaria en la UE sobre la base del instrumento que les resulte más ventajoso, las normas deben ser claras y aplicarse de forma coherente.
Summary:After almost a decade of applying the Cross-Border Healthcare Directive 2011/24/EU, this report revisits some outstanding issues regarding cross-border healthcare in the EU, such as the relationship between the Social Security Coordination Regulations and the Directive, clear and comprehensive information provision to patients and the challenges of cross-border telemedicine services. While the above legal instruments – the Directive and the Regulations – coexist and create a complementary system, the rules are sometimes very complex and difficult for the institutions and healthcare providers to apply and for the citizens to understand. The Regulations and the Directive overlap in terms of personal and material scope but are not identical. Hence, to ensure that persons seeking healthcare abroad receive healthcare within the EU based on the instrument that is most advantageous to them, the rules must be clear and applied in a coherent way.
