The European Commission has published itsthird annual report, which details the progress made towards achieving the objectives ofthe Digital Markets Act (DMA)to support fair and competitive digital markets in the EU.
The report provides information on the progress of proceedings opened under the DMA. Some of these proceedings concluded with the adoption oftwo infringement decisions, which involved fines: one concerning the non-manipulation of data and the other concerning consumers’ choices regarding the use of their personal data. In addition, last year, the Commission established the conditions for interoperability with connected devices, such as smartwatches or other wearable devices, bringing to a close two specification procedures launched in 2024.
The Commission also launchedthree market investigations relating to the cloud sector: two investigations into whether certain cloud computing services should be designated as gatekeepers, and a third investigation into the effectiveness of the DMA in supporting competitiveness and fairness in the cloud computing sector, as well asan infringement investigation into the possible downgrading of media publishers’ content in search results.
