The European Commission has sent Google a preliminary report setting out proposed measures to comply with theDigital Markets Act (DMA). Under these measures, Google would be required to allow third-party search engines to access search data —such as rankings, queries, clicks and impressions— on fair, reasonable and non – discriminatory terms.
The aim of these measures is to enable third-party online search engines, or ‘data beneficiaries’, to optimise their search services and compete with Google Search.
The proposed measures cover the following areas:
- The eligibility of data recipients to receive search data, including from artificial intelligence (AI) chatbots with search capabilities;
- The scope of the search data that Google must share;
- The means and frequency with which Google must share search data;
- Measures to ensure the anonymisation of personal data;
- Parameters for establishing fair, reasonable and non-discriminatory pricing for search data; and
- Processes governing data recipients’ access to search data.
