Título: The boundaries of the Commission’s discretionary powers when handling petitions and potential infringements of EU law
Resumen:Este estudio, encargado por el Departamento de Política de Derechos de los Ciudadanos y Asuntos Constitucionales del Parlamento Europeo a petición de la Comisión de Peticiones (PETI), analiza los límites legales de la discrecionalidad de la Comisión a la hora de decidir iniciar, o no, un procedimiento de infracción, especialmente en respuesta a una petición. Además, evalúa cómo la Comisión utiliza esta discrecionalidad en la práctica, y formula recomendaciones para mejorar la colaboración política entre el Parlamento Europeo y la Comisión, en interés de los ciudadanos de la UE.
Summary:This study commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the Committee on Petitions (PETI) analyses the legal limits on the discretion of the Commission when deciding to launch, or not to launch, an infringement action, especially in response to a petition. In addition, it assesses how the Commission uses this discretion in practice, and formulates recommendations on improved political collaboration between the European Parliament and the Commission, in the interest of EU citizens.
