Título: Study to support an impact assessment concerning the revision of Directive 2012/29/EU of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime - Final report
Resumen:El objetivo de este estudio era proporcionar a la Dirección General de Justicia de la Comisión Europea las pruebas y los análisis necesarios para que pudiera evaluar las repercusiones de una posible revisión del actual marco jurídico sobre los derechos de las víctimas de delitos, a saber, la Directiva 2012/29/UE (Directiva sobre los derechos de las víctimas). En particular, el estudio evaluó los costes y beneficios de las diferentes opciones políticas identificadas para mejorar la situación de las víctimas en la Unión Europea. Sobre la base de la investigación realizada, y en consonancia con el análisis comparativo de las repercusiones previstas de las opciones propuestas, ayudó a la Comisión a determinar el paquete preferido de opciones políticas para la revisión de la Directiva sobre los derechos de las víctimas. Este paquete de opciones obtiene la mejor puntuación en todos los criterios pertinentes y se espera que aporte los máximos beneficios a las víctimas de delitos en toda la Unión Europea, respetando al mismo tiempo los límites relacionados con la base jurídica y la proporcionalidad. Según los datos del estudio, los beneficios previstos de las opciones preferidas superan los costes previstos en cada Estado miembro. Las opciones políticas preferidas deberían tener efectos positivos significativos sobre los derechos de las víctimas, incluido un mejor acceso a la información, el apoyo y la protección, una mejor participación de las víctimas en los procesos penales y un mejor acceso a la indemnización por parte del delincuente.
Summary:The objective of this study was to provide the European Commission’s Directorate-General for Justice with the necessary evidence and analysis to enable it to assess the impacts of a possible revision of the current legal framework on the rights of victims of crime, namely Directive 2012/29/EU (the Victims’ Rights Directive). In particular, the study assessed the costs and benefits of the different policy options identified for improving the situation of victims in the European Union. Based on the conducted research, and in line with the comparative analysis of the expected impacts of the proposed options, it assisted the Commission in identifying the preferred package of policy options for the revision of the Victims’ Rights Directive. This package of options scores best on all the relevant criteria and is expected to bring maximum benefits to victims of crimes across the European Union, while respecting the limits connected to the legal basis and proportionality. According to data from the study, the expected benefits of the preferred options outweigh expected costs in each Member State. The preferred policy options should have significant positive effects on victims’ rights, including better access to information, support and protection, better participation of victims in criminal proceedings, and better access to compensation from the offender.
