Título: Smart contracts and the digital single market through the lens of a “law + technology” approach
Resumen:El despliegue de los contratos inteligentes en la zona europea podría fluidificar las transacciones económicas. También corre el riesgo de fragmentar el Mercado Único Digital ("MUD"). Este dilema exige una respuesta constructiva para preservar tanto los beneficios que aportan los contratos inteligentes como un MUD fuerte. En este contexto, el presente informe adopta un enfoque de "derecho + tecnología". Sugiere combinar el derecho y la tecnología para desarrollar soluciones que fomenten la evolución de los contratos inteligentes (en lugar de obstaculizarla) en una dirección que preserve y refuerce el MDS. El primer capítulo explica los entresijos del enfoque "derecho + tecnología" basándose en las enseñanzas de la biología evolutiva.
Summary:The deployment of smart contracts within the European zone could fluidify economic transactions. It also risks fragmenting the Digital Single Market (“DSM”). This conundrum calls for a constructive response to preserve both the benefits brought by smart contracts and a strong DSM. Against this background, this report adopts a “law + technology” approach. It suggests combining law and technology to develop solutions that encourage the evolution of smart contracts (rather than hindering it) in a direction that preserves and reinforces the DSM. The first chapter explains the ins and outs of the “law + technology” approach based on the teachings of evolutionary biology.
