Resumen:Se considera que Perú tiene altos estándares de protección de la PI. Según el Índice Internacional de Propiedad Intelectual (IPI) 2020, elaborado por la Cámara de Comercio de los Estados Unidos de América, de los 53 países que fueron evaluados, Perú fue identificado como el cuarto país con mayor crecimiento en materia de protección de la PI y, entre todas las economías latinoamericanas, ha logrado la mayor mejora global. Las PYME europeas deben ser cautelosas al entrar en el mercado peruano para asegurarse de que sus derechos de propiedad intelectual están adecuadamente protegidos allí. Recuerde que los derechos de propiedad intelectual registrados son de naturaleza territorial y, por tanto, sólo están protegidos en el territorio en el que han sido registrados. En consecuencia, los DPI registrados en Europa no tendrán validez legal en Perú, hasta que no se registren también en este país.
Summary:Peru is considered to have high standards of IP protection. According to the International Intellectual Property Index (IPI) 2020, prepared by the Chamber of Commerce of the United States of America, out of the 53 countries that were evaluated, Peru was identified as the fourth fastest growing country in the matter of IP protection and, amongst all Latin American economies, it has achieved the greatest overall improvement. European SMEs should be cautious when entering the Peruvian market to ensure that their intellectual property rights are adequately protected there. Remember that registered IP rights are territorial in nature and, therefore, they are only protected in the territory in which they have been registered. Consequently, IPRs registered in Europe will have no legal validity in Peru, until they are also registered in this country.
