Título: Country report, gender equality. How are EU rules transposed into national law? : Italy 2022
Resumen:El artículo 37 de la Constitución italiana de 1948 establece tanto la igualdad en el trabajo entre hombres y mujeres como el derecho de la mujer a unas condiciones de trabajo que le permitan cumplir sus funciones familiares esenciales y que otorguen una protección adecuada a la madre y al hijo. La ambigüedad de esta norma se basa en que el principio de igualdad está flanqueado por la necesidad de proteger a las mujeres como sujetos débiles del mercado laboral. La lógica de la protección prevaleció sobre la de la igualdad durante los 30 años siguientes. Durante ese periodo, junto a los instrumentos de protección necesarios para permitir a las mujeres cumplir con sus funciones familiares (como la protección contra el despido por razón de matrimonio o embarazo, el permiso de maternidad obligatorio y la prohibición de realizar trabajos pesados e insalubres durante el embarazo y la maternidad), se produjo un exceso de protección que disuadió a las mujeres de trabajar.
Summary:Article 37 of the Italian Constitution of 1948 states both equality at work between men and women and women’s right to working conditions that allow them to fulfil their essential family functions and grant adequate protection to the mother and the child. The ambiguity of this rule rests on the principle of equality being flanked by the necessity of protecting women as weak subjects of the labour market. The logic of protection prevailed over that of equality for the next 30 years. During that period, alongside instruments of protection necessary to allow women to fulfil their family functions (such as protection against dismissal on grounds of marriage or pregnancy, compulsory maternity leave, and a ban on heavy and unhealthy work during pregnancy and motherhood), there was an excess of protection that discouraged women from working.
