Resumen:La naturaleza tradicionalmente secreta y poco regulada del mercado del arte lo hace especialmente expuesto a la delincuencia financiera. Los intentos de regular el riesgo de blanqueo de capitales y de financiación del terrorismo no han tenido suficientemente en cuenta muchas de las vulnerabilidades inherentes al mercado del arte para el fraude y la explotación. A diferencia de cualquier otro mercado legítimo, la cultura de la confidencialidad en el mercado del arte, junto con el uso de jurisdicciones secretas, facilita la mezcla de legalidad e ilegalidad. Existen pruebas fiables de que la delincuencia organizada, las organizaciones terroristas y las milicias se aprovechan de la opacidad del mercado del arte para financiar sus actividades ilícitas.
Summary:The traditionally secretive and under-regulated nature of the art market makes it uniquely exposed to financial crime. Attempts to regulate the risk of money laundering and terrorism financing have not sufficiently taken into consideration many of the art market’s inherent vulnerabilities to fraud and exploitation. Unlike any other legitimate market, the culture of confidentiality in the art market coupled with the use of secrecy jurisdictions facilitates an intermixing of legality and illegality. Reliable evidence exists of organised criminals, terrorist organisations and militias taking advantage of the opacity of the art market to fund their illicit activities
