This binding decision seeks to address the dispute arisen following a draft decision issued by the Irish (IE) SA as lead supervisory authority (LSA) regarding WhatsApp Ireland Ltd. (WhatsApp IE)<b>\u00a0<\/b>and the subsequent objections expressed by a number of concerned supervisory authorities (CSAs). In accordance with the GDPR, the\u00a0<a href=\"https:\/\/edpb.europa.eu\/our-work-tools\/our-documents\/binding-decision-board-art-65\/binding-decision-12021-dispute-arisen_en\">EDPB\u2019s binding decision<\/a>\u00a0has now been published, following the notification of the\u00a0<a href=\"https:\/\/edpb.europa.eu\/our-work-tools\/consistency-findings\/register-for-decisions_en\">IE SA\u2019s final decision<\/a>\u00a0to the company.<\/p>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-scaled.jpg\"><img decoding=\"async\" class=\"wp-image-78735 aligncenter\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-scaled.jpg\" alt=\"\" width=\"434\" height=\"326\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-scaled.jpg 2560w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-300x225.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-1024x768.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-768x576.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-1536x1152.jpg 1536w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/09\/whatsapp-2048x1536.jpg 2048w\" sizes=\"(max-width: 434px) 100vw, 434px\" \/><\/a><\/p>\n<p>Following its assessment, the EDPB was of the opinion that the IE SA should amend its\u00a0<b>draft decision regarding infringements of transparency, the calculation of the fine, and the period for the order to comply.<\/b><\/p>\n<p>Regarding\u00a0<b>transparency<\/b>, the draft decision of the IE SA already identified a severe breach of Art. 12-13-14 GDPR. The EDPB identified additional shortcomings with the information provided, impacting users\u2019 ability to understand the legitimate interests being pursued. \u00a0Therefore, the EDPB requested the IE SA to include a finding of an infringement of Art. 13(1)(d) GDPR in its decision.<\/p>\n<p>In addition, the EDPB clarified that, while not every infringement of Art. 12-14 GDPR necessarily entails an infringement of Art. 5 (1) (a) GDPR, in this particular case, in light of the gravity and the overarching nature and impact of the infringements, there has been an\u00a0<b>infringement of the transparency principle enshrined in Art. 5(1)(a) GDPR<\/b>.<\/p>\n<p>Regarding WhatsApp IE\u2019s\u00a0<b>collection of data of non-users<\/b>\u00a0&#8211; when users decide to use the Contact Feature functionality &#8211; the EDPB found that in the present case, the procedure used by WhatsApp IE does not lead to anonymisation of the collected personal data.<\/p>\n<p>Regarding the\u00a0<b>imposed fine<\/b>\u00a0<b>and the calculation of the fine<\/b>, the EDPB decided that the turnover of an undertaking is not exclusively relevant for the determination of the maximum fine amount in accordance with Art. 83(4)-(6) GDPR, but it may also be considered for the calculation of the fine itself, where appropriate, to ensure the fine is effective, proportionate and dissuasive in accordance with Art. 83(1) GDPR.
