{"id":75803,"date":"2021-07-12T03:00:54","date_gmt":"2021-07-12T01:00:54","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=75803"},"modified":"2021-09-09T13:26:42","modified_gmt":"2021-09-09T11:26:42","slug":"european-parliament-vehemently-opposed-to-hungarian-anti-lgbtiq-law","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/european-parliament-vehemently-opposed-to-hungarian-anti-lgbtiq-law\/","title":{"rendered":"European Parliament vehemently opposed to Hungarian anti-LGBTIQ law"},"content":{"rendered":"<ul class=\"ep_list\">\n<li>\n<div class=\"ep-p_text\"><span class=\"ep_name\">New rules in Hungary in \u201cclear breach of EU values, principles and law\u201d<\/span><\/div>\n<\/li>\n<li>\n<div class=\"ep-p_text\"><span class=\"ep_name\">Political censorship and gradual dismantling of fundamental rights in Hungary<\/span><\/div>\n<\/li>\n<li>\n<div class=\"ep-p_text\"><span class=\"ep_name\">Commission and member states should take urgent legal action<\/span><\/div>\n<\/li>\n<li>\n<div class=\"ep-p_text\"><span class=\"ep_name\">Cut funding where European budget is affected by national legislation that clashes with EU values<\/span><\/div>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-scaled.jpg\"><img decoding=\"async\" class=\" wp-image-75800 aligncenter\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-1024x683.jpg\" alt=\"\" width=\"502\" height=\"335\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-1024x683.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-300x200.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-768x512.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-1536x1024.jpg 1536w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/07\/derechos_LGBTQ_Europa_Hungria-2048x1366.jpg 2048w\" sizes=\"(max-width: 502px) 100vw, 502px\" \/><\/a><\/p>\n<div class=\"ep_gridcolumn ep-m_product\" data-view1200=\"6\" data-view1020=\"6\" data-view750=\"10\" data-view640=\"6\" data-view480=\"8\" data-view320=\"4\">\n<div class=\"ep_gridcolumn-content\">\n<div class=\"ep-a_text ep-layout_chapo\">\n<p><strong>Parliament \u201ccondemns in the strongest possible terms\u201d the recent anti-LGBTIQ legislation and denounces the dismantling of democracy and the rule of law in Hungary.<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"ep_gridcolumn ep-m_product\" data-view1200=\"6\" data-view1020=\"6\" data-view750=\"10\" data-view640=\"6\" data-view480=\"8\" data-view320=\"4\">\n<div class=\"ep_gridcolumn-content\">\n<div class=\"ep-a_text\">\n<p class=\"ep-wysiwig_paragraph\">In a resolution, adopted with 459 in favour 147 against, and 58 abstentions on Thursday, MEPs describe the Hungarian law as being in clear breach of fundamental rights enshrined in the\u00a0<a href=\"https:\/\/ec.europa.eu\/info\/aid-development-cooperation-fundamental-rights\/your-rights-eu\/eu-charter-fundamental-rights_en\" target=\"_blank\" rel=\"noopener\">EU Charter of fundamental rights<\/a>, the Treaties and EU internal market legislation.<\/p>\n<h3 class=\"ep-wysiwig_paragraph\"><strong>Yet another attack on democracy, the rule of law, and fundamental rights<\/strong><\/h3>\n<p class=\"ep-wysiwig_paragraph\">Parliament stresses this is not an isolated incident, but \u201crather constitutes another intentional and premeditated example of the gradual dismantling of fundamental rights in Hungary\u201d, where state-sponsored LGBTIQ-phobia and disinformation campaigns have become tools for political censorship. These human rights violations are part of a broader political agenda to break down democracy and the rule of law, including media freedom, and should be considered a systemic violation of\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/treaty\/teu_2012\/art_2\/oj\" target=\"_blank\" rel=\"noopener\">EU values<\/a>.<\/p>\n<p class=\"ep-wysiwig_paragraph\">Recent manifestations of this problem include amending the country\u2019s Constitution to declare that \u201cthe mother is a female and the father is a male\u201d, and the de facto ban of legal gender recognition for transgender and intersex persons. In this context, MEPs state their unwavering commitment to defend children\u2019s rights, declaring that tolerance, acceptance, and diversity should serve as guiding principles to ensure the best interests of the child are respected.<\/p>\n<h3 class=\"ep-wysiwig_paragraph\"><strong>Urgent action needed<\/strong><\/h3>\n<p class=\"ep-wysiwig_paragraph\">MEPs call on the Commission to launch an accelerated infringement procedure and to use all tools in the Court of Justice, such as interim measures and penalties for non-compliance if necessary. They also call on the member states to bring the matter to the CJEU should the Commission not act, and to launch an inter-state application to the European Court of Human Rights.<\/p>\n<p class=\"ep-wysiwig_paragraph\">Furthermore, Parliament points to a number of issues in Hungary where the Rule of Law Conditionality Regulation should be immediately triggered to protect the EU budget, and expresses serious concerns that the Hungarian Recovery and Resilience Plan may not comply with EU law. It also calls on the Council and the Commission to unblock the\u00a0<a href=\"https:\/\/www.europarl.europa.eu\/legislative-train\/theme-area-of-justice-and-fundamental-rights\/file-anti-discrimination-directive\" target=\"_blank\" rel=\"noopener\">Anti-Discrimination Directive<\/a>, and to follow up on Parliament\u2019s initiative on the\u00a0<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20201002IPR88432\/parliament-demands-a-legally-binding-effective-mechanism-to-protect-eu-values\" target=\"_blank\" rel=\"noopener\">establishment of a permanent EU mechanism on democracy, the rule of law and fundamental rights<\/a>.
