It uses on the labels of those products the terms\u00a0\u2018balsamico\u2019 and \u2018deutscher balsamico\u2019, which are included under the legends \u2018Theo der Essigbrauer, Holzfassreifung, Deutscher balsamico traditionell, naturtr\u00fcb aus badischen Weinen\u2019 (Theo the vinegar brewer, matured in wooden barrels, German balsamic vinegar, traditional, naturally cloudy, made from Baden wines) or \u20181. Deutsches Essig-Brauhaus, Premium, 1868, Balsamico, Rezeptur No 3\u2019 (first German vinegar brewery, premium, 1868, balsamic, recipe No 3).<\/p>\n<p>Consorzio Tutela Aceto Balsamico di Modena, a consortium of producers of products designated by the name \u2018Aceto Balsamico di Modena (PGI)\u2019, requested that Balema refrain from using the term \u2018balsamico\u2019. In response, Balema brought an action before the German courts seeking a declaration that it has the right to use that term for those products.<\/p>\n<p>The Bundesgerichtshof (Federal Court of Justice, Germany), in the case currently before it, asks the Court of Justice to determine whether the protection of the name \u2018Aceto Balsamico di Modena\u2019, which is conferred by the regulation on the protection of geographical indications and designations of origin for agricultural products and foodstuffs 2 covers only that entire name, that is \u2018Aceto Balsamico di Modena\u2019, or extends to the use of the non-geographical terms of that name, that is\u00a0\u2018aceto\u2019, \u2018balsamico\u2019 and \u2018aceto balsamico\u2019.<\/p>\n<p>In today\u2019s judgment, the Court declared that the protection of the name \u2018Aceto Balsamico di Modena\u2019 does not extend to the use of the individual non-geographical terms of that name.<\/p>\n<p>The Court emphasises that the registration of the PGI at issue and the protection deriving from it cover the name \u2018Aceto Balsamico di Modena\u2019 as a whole, as it is that name that has an undeniable reputation on the national and international market. In contrast, the non-geographical terms of that PGI, that is \u2018aceto\u2019 and \u2018balsamico\u2019, and their use in combination and in translation cannot benefit from that protection, especially because the term \u2018aceto\u2019 is a common term3 and the term \u2018balsamico\u2019 is an adjective that is commonly used to refer to a vinegar with a bitter-sweet flavour.<\/p>\n<p>The Court also observes that the terms \u2018aceto\u2019 and \u2018balsamico\u2019 appear in the registered PDOs \u2018Aceto balsamico tradizionale di Modena\u2019 and \u2018Aceto balsamico tradizionale di Reggio Emilia\u2019 without their use infringing the protection conferred on the PGI at issue.<\/p>\n<h3>More Information<\/h3>\n<p><a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2019-12\/cp190150en.pdf\">Press Release<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The name \u2018Aceto Balsamico di Modena (PGI)\u2019 (balsamic vinegar from Modena, Italy) has been registered since 2009 in the register of protected designations of origin (\u2018PDO\u2019) and protected geographical indications (\u2018PGI\u2019).
