{"id":20618,"date":"2019-06-27T08:00:38","date_gmt":"2019-06-27T06:00:38","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=20618"},"modified":"2019-06-26T08:31:51","modified_gmt":"2019-06-26T06:31:51","slug":"adoption-of-new-rules-to-better-protect-children-caught-in-cross-border-parental-disputes","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/adoption-of-new-rules-to-better-protect-children-caught-in-cross-border-parental-disputes\/","title":{"rendered":"Adoption of new rules to better protect children caught in cross-border parental disputes"},"content":{"rendered":"<p><strong><em>The EU makes it easier and faster for decisions on divorce, legal separation and marriage annulment, as well as on parental responsibility issues and international child abduction to be applied across borders.<\/em><\/strong><\/p>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2019\/04\/adult-cute-daughter-701014.jpg\"><img decoding=\"async\" class=\"size-medium wp-image-15506 aligncenter\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2019\/04\/adult-cute-daughter-701014-300x200.jpg\" alt=\"madre abrazando a su hijo peque\u00f1o mientras lleva a un beb\u00e9 atado a s\u00ed misma\" width=\"300\" height=\"200\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2019\/04\/adult-cute-daughter-701014-300x200.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2019\/04\/adult-cute-daughter-701014.jpg 640w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>The Council recently adopted a revision of the so-called <strong><em>Brussels IIa regulation<\/em><\/strong> which sets out rules on the jurisdiction, recognition and enforcement of decisions in matrimonial matters and matters of parental responsibility, as well as on intra-EU child abduction.<\/p>\n<p>One of the main objectives of the revision is to<strong> improve the current legal rules that protect children in cases of cross-border parental responsibility disputes, such as those related to custody, access rights and child abduction.<\/strong><\/p>\n<p>The new rules amend several aspects of the existing Brussels IIa regulation and foresee in particular:<\/p>\n<ul>\n<li><strong>clearer rules on the opportunity for the child to express his\/her views<\/strong> with the introduction of an obligation to give the child a genuine and effective opportunity to express his\/her views;<\/li>\n<li>the <strong>complete abolition of exequatur<\/strong> for all decisions in matters of parental responsibility. This will save time and money for citizens whenever a decision needs to circulate from one member state to another. This abolition of exequatur is accompanied by a number of procedural safeguards;<\/li>\n<li><strong>enhanced and clearer rules on intra-EU child abduction<\/strong> <strong>cases<\/strong> with the introduction, for example, of clear deadlines to ensure that these cases are treated in the most expeditious manner;<\/li>\n<li><strong>clearer rules on the circulation of authentic instruments and extra-judicial agreements.<\/strong> The text foresees that agreements on divorce, legal separation or matters of parental responsibility, will be allowed to circulate when they are accompanied by the relevant certificate.<\/li>\n<li>cl<strong>earer provisions on the placement of a child in another member state<\/strong>, including the need to obtain prior consent for all placements, except where a child is to be placed with a parent;<\/li>\n<li>the <strong>harmonisation of certain rules for the enforcement procedure.<\/strong> While the enforcement procedure remains governed by the law of the member state of enforcement, the regulation includes some harmonised grounds for suspending or refusing enforcement, thereby giving more legal certainty to parents and children.<\/li>\n<\/ul>\n<h2>More information<\/h2>\n<p>Access the <a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2019\/06\/25\/more-effective-rules-to-deal-with-cross-border-matrimonial-matters-and-parental-responsibility-issues\/\">complete news<\/a><\/p>\n<p>Related video:\u00a0<a href=\"https:\/\/www.cde.ual.es\/the-eu-works-to-protect-our-children-and-families\/\">The EU works to protect our children and families<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The EU makes it easier and faster for decisions on divorce, legal separation and marriage annulment, as well as on parental responsibility issues and international child abduction to be applied across borders.
