{"id":165740,"date":"2026-02-19T03:00:18","date_gmt":"2026-02-19T02:00:18","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=165740"},"modified":"2026-02-18T11:35:15","modified_gmt":"2026-02-18T10:35:15","slug":"la-comision-inicia-una-investigacion-sobre-shein-en-virtud-de-la-ley-de-servicios-digitales","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/la-comision-inicia-una-investigacion-sobre-shein-en-virtud-de-la-ley-de-servicios-digitales\/","title":{"rendered":"Commission launches investigation into Shein under the Digital Services Act"},"content":{"rendered":"<p style=\"text-align: justify;\"><span dir=\"auto\">The European Commission has today opened formal proceedings against Shein under the Digital Services Act for its addictive design, lack of transparency in its recommendation systems, and the sale of illegal products, including child sexual abuse material.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/05\/online-shopping-gab9b0891a_1920.jpg\" alt=\"tienda online\" width=\"596\" height=\"447\" \/><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">More specifically, the investigation will focus on the following areas:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span dir=\"auto\">The systems Shein has implemented to limit the <\/span><strong><span dir=\"auto\">sale of illegal products<\/span><\/strong><strong><span dir=\"auto\">in the European Union<\/span><\/strong><span dir=\"auto\">, i<\/span><span dir=\"auto\">ncluding content that could constitute child sexual abuse material, such as child-like sex dolls.<\/span><\/li>\n<li><span dir=\"auto\">The risks associated with <\/span><strong><span dir=\"auto\">the addictive design of the service<\/span><\/strong><span dir=\"auto\">, including the awarding of points or rewards for consumer interaction, as well as the systems Shein has implemented to mitigate these risks. Addictive features could have a negative impact on user well-being and online consumer protection.\u00a0\u00a0<\/span><\/li>\n<li><span dir=\"auto\">The <\/span><strong><span dir=\"auto\">transparency of the recommendation systems that Shein uses to propose content and products to users<\/span><\/strong><span dir=\"auto\">. Under the DSA, Shein must disclose the main parameters used in its recommendation systems and provide users with at least one easily accessible option that is not based on profiling for each recommendation system.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span dir=\"auto\">The Commission will now conduct a thorough investigation as a matter of priority. The opening of a formal procedure does not prejudge the outcome.<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">Coimisi\u00fan na Me\u00e1n, Digital Services Coordinator for Ireland, will also be associated with the Commission&#8217;s investigation as the National Digital Services Coordinator in Shein&#8217;s country of establishment in the EU.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span dir=\"auto\" style=\"font-size: 14pt;\">Next steps<\/span><\/h3>\n<p style=\"text-align: justify;\"><span dir=\"auto\">Following the formal opening of the procedure, the Commission will continue to gather evidence, for example by sending additional requests for information to Shein or third parties or by conducting monitoring actions or interviews.<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">The opening of a formal procedure empowers the Commission to take additional enforcement measures, such as precautionary measures or the adoption of a decision of non-compliance. The Commission is also empowered to accept commitments made by Shein to remedy the issues subject to the procedure.<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">The DSA does not set a legal deadline for the conclusion of a formal procedure. The duration of a thorough investigation depends on several factors, such as the complexity of the case, the degree of cooperation of the company concerned with the Commission and the exercise of its right of defence. Furthermore, the opening of a formal procedure does not prejudge its outcome or any other procedure that the Commission may decide to initiate under other articles of the DSA.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span dir=\"auto\">Background<\/span><\/h3>\n<p style=\"text-align: justify;\"><span dir=\"auto\">Today&#8217;s decision follows preliminary analyses of the risk assessment reports provided by Shein, responses to formal requests for information from the Commission, and information shared by third parties.<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">The Commission sent three requests for information to Shein on<\/span><span dir=\"auto\">28 June 2024<\/span><span dir=\"auto\">,<\/span><span dir=\"auto\">6 February 2025<\/span><span dir=\"auto\">and<\/span><span dir=\"auto\">26 November 2025<\/span><span dir=\"auto\">asking for further information on the company&#8217;s compliance with the DSA, in particular in relation to consumer and child protection, and on the transparency of its recommendation systems.<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"auto\">The formal proceedings under the DSA are without prejudice to and complement the<\/span><span dir=\"auto\">ongoing coordinated actions<\/span><span dir=\"auto\">for Shein&#8217;s compliance with its obligations under consumer legislation, led by the<\/span><span dir=\"auto\">Consumer Protection Cooperation (CPC) Network<\/span><span dir=\"auto\">of national consumer protection authorities, and enforcement actions at national level.
