The Commission welcomed last December 12’s decision by EU Member States<\/span><\/span>\u00a0<\/span>to<\/span>\u00a0introduce a \u20ac<\/span><\/span>3<\/span>\u00a0<\/span>customs duty<\/span><\/span>\u00a0<\/span><\/span>per item<\/span><\/span>\u00a0<\/span>on e-commerce parcels valued below \u20ac150<\/span>,\u00a0<\/span>starting in\u00a0<\/span><\/span>July\u00a0<\/span>2026<\/span><\/span>.\u00a0<\/span><\/span>The new\u00a0<\/span>duty will help<\/span>\u00a0protect the competitiveness of European businesses by\u00a0<\/span>leve<\/span>ll<\/span>ing the<\/span>\u00a0playing field between e-commerce\u00a0<\/span>and traditional<\/span>\u00a0<\/span>retail<\/span><\/span>.\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n

<\/p>\n<\/div>\n

\n

Given the rapid<\/span>\u00a0increase in e-commerce goods being imported into the EU, the Commission and Member States\u00a0<\/span>have\u00a0<\/span>together\u00a0<\/span>acknowledged<\/span>\u00a0<\/span>the need for an urgent solution, which will<\/span>\u00a0bridge the gap until the setting up of the EU Custo<\/span>m<\/span>s<\/span>\u00a0Data H<\/span>ub in 2028, as part of the\u00a0<\/span><\/span>EU customs reform<\/span><\/span>.\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

The<\/span>\u00a0Council and the Commission\u00a0<\/span>are working<\/span>\u00a0to enable\u00a0<\/span>the\u00a0<\/span>implementation\u00a0<\/span>of this temporary measure<\/span>,\u00a0<\/span>through\u00a0<\/span>appropriate legal<\/span>\u00a0amendments and\u00a0<\/span>by ensuring a\u00a0<\/span>well-functioning\u00a0<\/span>IT\u00a0<\/span>framework<\/span>.<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

The\u00a0<\/span>permanent\u00a0<\/span>customs duty regime will apply once the EU Customs Data Hub<\/span>\u00a0is\u00a0<\/span>established<\/span>. The EU Customs Data Hub will fully integrate\u00a0<\/span>new\u00a0<\/span>customs data<\/span>\u00a0related to e-commerce<\/span>, providing customs services with a complete picture of goods entering or exiting the EU.\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

The temporary customs duty of \u20ac3 per item will apply to parcels\u00a0<\/span>sent directly to<\/span>\u00a0consumers from third countries<\/span>. This measure is separate from the ongoing negotiation of an EU handling fee on e-commerce parcels.<\/span>\u00a0<\/span>W<\/span>hile the customs duty\u00a0<\/span>eliminates<\/span>\u00a0a competitive advantage that the e<\/span>–<\/span>commerce operators currently enjoy, the handling fee<\/span>\u00a0is meant to compensate for the increasing costs that customs authorities incur for supervising the\u00a0<\/span>very significant<\/span>\u00a0flow of parcels<\/span>.<\/span><\/span><\/p>\n

\n

Protecting EU business from the e-commerce boom<\/span>\u00a0<\/strong><\/p>\n<\/div>\n

\n

T<\/span>he new customs rules for e-commerce<\/span>, proposed in the Commission<\/span>‘<\/span>s\u00a0<\/span>c<\/span>ustoms\u00a0<\/span>r<\/span>eform, will<\/span>\u00a0reinforce the EU customs\u00a0<\/span>union<\/span>\u00a0and better equip customs authorities to<\/span>\u00a0<\/span>protect the<\/span>\u00a0<\/span>EU retail trade and its workers, as well as EU consumers<\/span>.\u00a0<\/span>T<\/span>hey<\/span><\/span>\u00a0<\/span><\/span>are vital to create a level playing field for our EU businesses against growing competition from online platforms<\/span>\u00a0abroad<\/span>.\u00a0<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

Background<\/span>\u00a0<\/strong><\/p>\n<\/div>\n

\n

Today, parcels valued below \u20ac150 that are sent from a third country directly to a consumer in the EU are exempt from\u00a0<\/span>customs\u00a0<\/span>duties.\u00a0<\/span>The Commission proposed the removal of th<\/span>is<\/span>\u00a0exemption\u00a0<\/span>in May 2023 as part of the\u00a0<\/span>c<\/span>ustoms\u00a0<\/span>r<\/span>eform<\/span>.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

The\u00a0<\/span>initial<\/span>\u00a0<\/span>propos<\/span>al<\/span>\u00a0for the removal\u00a0<\/span>foresaw application<\/span>\u00a0as from mid-2028.<\/span>\u00a0T<\/span>he\u00a0<\/span>Council adopted the removal of the exemption\u00a0<\/span>on\u00a0<\/span><\/span>13<\/span><\/span>th<\/span><\/span>\u00a0of November 2025<\/span><\/span>,\u00a0<\/span>and called for an earlier application of the measure already in 2026.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

In<\/span>\u00a0<\/span>addition, in\u00a0<\/span>February 2025<\/span>\u00a0in its communication on e-commerce<\/span>, the Commission introduced the idea of a Union handling fee on goods imported directly to consumers. It was introduced in the customs reform proposal by the Council in its negotiating mandate in June 2025.<\/span><\/span>\u00a0<\/span><\/span>The handling fee is meant to compensate for the increasing costs for customs authorities of ensuring the release of those goods for free circulation.<\/span><\/span>\u00a0<\/span><\/p>\n<\/div>\n

\n

A<\/span>ccording to the Council mandate<\/span>,<\/span>\u00a0the handling fee should enter into force in November 2026. The content and date are currently under negotiation between the Council and the European Parliament in the context of the ongoing customs reform proposal trilogues.<\/span><\/span>\u00a0<\/span><\/p>\n
