{"id":157919,"date":"2025-03-11T09:12:48","date_gmt":"2025-03-11T08:12:48","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=157919"},"modified":"2025-03-11T09:12:48","modified_gmt":"2025-03-11T08:12:48","slug":"protecting-eu-consumers-more-than-half-of-second-hand-online-traders-fail-to-meet-eu-consumer-laws","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/protecting-eu-consumers-more-than-half-of-second-hand-online-traders-fail-to-meet-eu-consumer-laws\/","title":{"rendered":"Protecting EU consumers: More than half of second-hand online traders fail to meet EU consumer laws"},"content":{"rendered":"<p style=\"text-align: justify;\">Every year, millions of European consumers use online traders to buy second-hand goods, such as clothes, electronic equipment, toys, and more.<\/p>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2025\/03\/vendedor-masculino-que-controla-peso-tela-escalas-tienda-ropa_23-2148175675.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-157917 size-portfolio\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2025\/03\/vendedor-masculino-que-controla-peso-tela-escalas-tienda-ropa_23-2148175675-620x380.jpg\" alt=\"\" width=\"620\" height=\"380\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">When buying second-hand goods, European law states that consumers are entitled to the same guarantee and information on a product, on their rights and the trader they are buying from, as when buying any other goods.<\/p>\n<p style=\"text-align: justify;\">The EU is committed to ensuring consumers are not misled by traders&#8217; commercial practices and that EU consumer protection laws are enforced.<\/p>\n<p style=\"text-align: justify;\">For this, the European Commission and national consumer protection authorities of 25 EU countries, Iceland and Norway, recently conducted a screening (\u201csweep\u201d) of 356 online traders, operating websites or platforms selling second-hand goods, to check whether their practices were compliant with EU consumer law.<\/p>\n<p style=\"text-align: justify;\">They identified that 52% of the reviewed online traders were in potential breach of EU consumer law.<\/p>\n<ul style=\"text-align: justify;\">\n<li>40%\u00a0<strong>did not inform consumers about their right of withdrawal<\/strong>\u00a0in a clear manner, such as the right to return a product within 14 days without justification or cost;<\/li>\n<li>45%\u00a0<strong>did not correctly inform consumers of their right to return faulty goods<\/strong>\u00a0or goods that do not look or work as advertised;<\/li>\n<li>57%\u00a0<strong>did not respect the minimum period of one year legal guarantee<\/strong>\u00a0for second-hand goods;<\/li>\n<li>34% of traders presented\u00a0<strong>environmental claims<\/strong>\u00a0on their website, of which 20% were\u00a0<strong>not sufficiently substantiated<\/strong>, and 28% were\u00a0<strong>false, deceptive, or qualified as unfair commercial practices<\/strong>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The EU is dedicated to ensuring that consumers are provided with better information on the durability and reparability of goods and the consumer&#8217;s legal guarantee rights at the point of sale.<\/p>\n<p style=\"text-align: justify;\">Consumer authorities have earmarked 185 traders for further investigation and will decide whether to take further action and request compliance according to their national procedures.<\/p>\n<p style=\"text-align: justify;\"><strong>For more information <a href=\"https:\/\/commission.europa.eu\/news\/protecting-eu-consumers-more-half-second-hand-online-traders-fail-meet-eu-consumer-laws-2025-03-10_en?prefLang=es\">European Commission.<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Every year, millions of European consumers use online traders to buy second-hand goods, such as clothes, electronic equipment, toys, and more.
