Under the DMA, Apple must provide free and effective interoperability to third party developers and businesses with hardware and software features controlled by Apple&#8217;s\u00a0<strong>operating systems iOS and iPadOS<\/strong>, designated under the DMA.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter size-full wp-image-153243\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1917\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-scaled.jpg 2560w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-300x225.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-1024x767.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-768x575.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-1536x1150.jpg 1536w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/09\/pexels-armandvalendez-544295-2048x1534.jpg 2048w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">The specification proceedings formalise the Commission&#8217;s regulatory dialogue with\u00a0<strong>Apple<\/strong>\u00a0on certain specific areas of Apple&#8217;s compliance with Article 6(7) DMA. Pursuant to<strong>\u00a0Article 8(2) of the DMA<\/strong>, the Commission may, on its own initiative, adopt a decision specifying the measures a gatekeeper has to implement to ensure effective compliance with substantive DMA obligations, such as the interoperability obligation of Article 6(7) DMA.<\/p>\n<p style=\"text-align: justify;\">The\u00a0<strong>first<\/strong>\u00a0<strong>proceeding<\/strong>\u00a0focuses on several\u00a0<strong>iOS connectivity features and functionalities, predominantly used for and by connected devices.\u00a0<\/strong>Connected devices are a varied, large and commercially important group of products, including smartwatches, headphones and virtual reality headsets. Companies offering these products depend on\u00a0<strong>effective interoperability with smartphones and their operating systems<\/strong>, such as iOS. The Commission intends to specify how Apple will provide effective interoperability with functionalities such as notifications, device pairing and connectivity.<\/p>\n<p style=\"text-align: justify;\">The\u00a0<strong>second proceeding<\/strong>\u00a0focuses on the\u00a0<strong>process Apple has set up to address interoperability requests\u00a0<\/strong>submitted by developers and third parties for iOS and IPadOS. It is crucial that\u00a0<strong>the request process is transparent, timely, and fair<\/strong>\u00a0so that all developers have an effective and predictable path to interoperability and are enabled to innovate.<\/p>\n<p style=\"text-align: justify;\"><strong>Next steps<\/strong><\/p>\n<p style=\"text-align: justify;\">The Commission will conclude<strong>\u00a0<\/strong>the proceedings\u00a0<strong>within 6 months from their opening<\/strong>. In the course of these proceedings, the Commission will communicate its preliminary findings to Apple, where it will explain the measures the gatekeeper should take to effectively comply with the interoperability obligation of the DMA. A non-confidential summary of the preliminary findings and envisaged measures will be published to enable third parties to provide comments.<\/p>\n<p style=\"text-align: justify;\">These proceedings are without prejudice to the powers of the Commission to adopt a decision establishing non-compliance with any of the obligations laid down in the DMA by a gatekeeper, including the possibility to impose fines or periodic penalty payments.<\/p>\n<p style=\"text-align: justify;\"><strong>Background<\/strong><\/p>\n<p style=\"text-align: justify;\">The DMA aims to ensure contestable and fair markets in the digital sector. It regulates gatekeepers, which are large digital platforms that provide an important gateway between business users and consumers, whose position can grant them the power to create a bottleneck in the digital economy.<\/p>\n<p style=\"text-align: justify;\">On 6<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_23_4328\">\u00a0September 2023<\/a>, the Commission designated Apple&#8217;s online intermediation service App Store, Apple&#8217;s operating system iOS, and Apple&#8217;s web browser Safari as core platform services. On\u00a0<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_24_2363\">29 April 2024<\/a>, the Commission adopted a decision designating Apple&#8217;s iPadOS, the operating system for tablets, as a core platform service under the DMA.
