The flagship legislation follows a\u00a0<strong>\u2018risk-based\u2019 approach<\/strong>, which means the\u00a0<strong>higher the risk<\/strong>\u00a0to cause harm to society,\u00a0<strong>the stricter the rules<\/strong>. It is the first of its kind in the world and can set a global standard for AI regulation.<\/span><\/p>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-scaled.jpg\"><img decoding=\"async\" class=\"aligncenter size-full wp-image-151605\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1706\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-scaled.jpg 2560w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-300x200.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-1024x683.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-768x512.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-1536x1024.jpg 1536w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/inteligencia-artificial-2-2048x1365.jpg 2048w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">The new law aims to foster the development and uptake of\u00a0<strong>safe<\/strong>\u00a0and\u00a0<strong>trustworthy<\/strong>\u00a0AI systems across the EU\u2019s single market by both private and public actors. At the same time, it aims to ensure respect of\u00a0<strong>fundamental rights<\/strong>\u00a0of EU citizens and stimulate investment and innovation on artificial intelligence in Europe. The AI act applies only to areas within EU law and provides exemptions such as for systems used exclusively for\u00a0<strong>military and defence<\/strong>\u00a0as well as for\u00a0<strong>research<\/strong> purposes.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Classification of AI systems as high-risk and prohibited AI practices<\/strong><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">The new law categorises different types of artificial intelligence according to risk. AI systems presenting only\u00a0<strong>limited risk<\/strong>\u00a0would be subject to very light transparency obligations, while\u00a0<strong>high-risk<\/strong>\u00a0AI systems would be authorised, but subject to a set of requirements and obligations to gain access to the EU market. AI systems such as, for example,\u00a0<strong>cognitive behavioural manipulation<\/strong>\u00a0and\u00a0<strong>social scoring<\/strong>\u00a0will be banned from the EU because their risk is deemed unacceptable. The law also prohibits the use of AI for\u00a0<strong>predictive policing<\/strong>\u00a0based on profiling and systems that use\u00a0<strong>biometric data<\/strong>\u00a0to categorise people according to specific categories such as race, religion, or sexual orientation.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>General purpose AI models<\/strong><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">The AI act also addresses the use of\u00a0<strong>general-purpose AI (GPAI)<\/strong>\u00a0models.<\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">GPAI models not posing systemic risks will be subject to some limited requirements, for example with regard to\u00a0<strong>transparency<\/strong>, but those with systemic risks will have to comply with stricter rules.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>A new governance architecture<\/strong><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">To ensure proper enforcement, several governing bodies are set up:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span lang=\"EN-GB\">An\u00a0<strong>AI Office<\/strong>\u00a0within the Commission to enforce the common rules across the EU<\/span><\/li>\n<li><span lang=\"EN-GB\">A\u00a0<strong>scientific panel of independent experts<\/strong>\u00a0to support the enforcement activities<\/span><\/li>\n<li><span lang=\"EN-GB\">An\u00a0<strong>AI Board<\/strong>\u00a0with member states\u2019 representatives to advise and assist the Commission and member states on consistent and effective application of the AI Act<\/span><\/li>\n<li><span lang=\"EN-GB\">An\u00a0<strong>advisory forum for stakeholders<\/strong>\u00a0to provide technical expertise to the AI Board and the Commission<\/span><\/li>\n<\/ul>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/en\/artificial-intelligence-is-the-eus-grand-plan-succeeding\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/05\/d80d9778-3b71-43e2-a28b-05e9f4d3913d.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/artificial-intelligence-is-the-eus-grand-plan-succeeding\/\" target=\"_blank\" rel=\"noopener\">Artificial intelligence: is the EU&#8217;s grand plan succeeding?<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\"><strong>Penalties<\/strong><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">The fines for infringements to the AI act are set as a percentage of the offending company\u2019s\u00a0<strong>global annual turnover<\/strong>\u00a0in the previous financial year or a predetermined amount, whichever is higher. SMEs and start-ups are subject to proportional administrative fines.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Transparency and protection of fundamental rights<\/strong><\/p>\n<p style=\"text-align: justify;\"><span lang=\"EN-GB\">Before a high-risk AI system is deployed by some entities providing public services, the\u00a0<strong>fundamental rights impact<\/strong>\u00a0will need to be assessed. The regulation also provides for increased transparency regarding the development and use of high-risk AI systems. High-risk AI systems, as well as certain users of a high-risk AI system that are public entities will need to be registered in the\u00a0<strong>EU database<\/strong>\u00a0for high-risk AI systems, and users of an\u00a0<strong>emotion recognition system<\/strong>\u00a0will have to inform natural persons when they are being exposed to such a system.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Measures in support of innovation<\/strong><\/p>\n<p style=\"text-align: justify;\">The AI act provides for an innovation-friendly legal framework and aims to promote evidence-based regulatory learning. The new law foresees that AI regulatory sandboxes, enabling a controlled environment for the development, testing and validation of innovative AI systems, should also allow for testing of innovative AI systems in real world conditions.<\/p>\n<p style=\"text-align: justify;\"><strong>Next steps<\/strong><\/p>\n<p style=\"text-align: justify;\">After being signed by the presidents of the European Parliament and of the Council, the legislative act will be published in the EU\u2019s Official Journal in the coming days and enter into force twenty days after this publication.
