It consists of strategic initiatives to combat counterfeiting and strengthen the enforcement of intellectual property rights, setting out dedicated tools to increase companies&#8217; resilience and ability to better protect their intangible assets, including against cyber-theft.<\/p>\n<p style=\"text-align: justify;\">Key actions proposed by the Commission in its Recommendation include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Designating a\u00a0<strong>single contact point for IP enforcement<\/strong>\u00a0matters and extending the use of existing tools, such as the\u00a0<a href=\"https:\/\/euipo.europa.eu\/ohimportal\/en\/web\/observatory\/ip-enforcement-portal-home-page\">IP Enforcement Portal<\/a>\u00a0made available by the EU Intellectual Property Office (EUIPO).<\/li>\n<li>Encouraging signatories to the\u00a0<a href=\"https:\/\/single-market-economy.ec.europa.eu\/industry\/strategy\/intellectual-property\/enforcement-intellectual-property-rights\/memorandum-understanding-sale-counterfeit-goods-internet_en\">Memorandum of Understanding on the sale of counterfeit goods on the internet<\/a>\u00a0to seek\u00a0<strong>\u2018trusted flagger status&#8217;<\/strong>\u00a0under the\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\">Digital Services Act<\/a>, thereby ensuring that they are given priority when submitting any notices of illegal content. Signatories and other intermediaries&#8217; services providers are encouraged to participate in the modernisation of the\u00a0<a href=\"https:\/\/single-market-economy.ec.europa.eu\/industry\/strategy\/intellectual-property\/enforcement-intellectual-property-rights\/memorandum-understanding-sale-counterfeit-goods-internet_en\">Memorandum of Understanding<\/a>.<\/li>\n<li>Adapting procedures to counter\u00a0<strong>new counterfeiting practices<\/strong>, addressing issues like mirror websites with dynamic injunctions, optimising information sharing in court proceedings, and ensuring appropriate compensation for damages, including both material and moral damages.<\/li>\n<li>Promoting the use of\u00a0<strong>alternative dispute resolution<\/strong>\u00a0for all IP disputes, offering a cost-effective and efficient option, especially for cross-border disputes and SMEs.<\/li>\n<li>Reassess and potentially increase the\u00a0<strong>maximum sanctions<\/strong>\u00a0on serious criminal IP offences.<\/li>\n<li>Empower<strong>\u00a0market surveillance authorities<\/strong>\u00a0to further detect and combat counterfeiting.<\/li>\n<li>Develop practices aiming at faster, cheaper, and more ecological\u00a0<strong>storage and disposal<\/strong>\u00a0of counterfeits.<\/li>\n<li>Adapting IP practices to\u00a0<strong>AI and virtual worlds<\/strong>, using blockchain for supply chain traceability and content recognition systems to detect counterfeiting and pirated goods.<\/li>\n<li>Integrating IP content in\u00a0<strong>national training and education<\/strong>\u00a0curricula, especially for law enforcement and business studies.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Key tools proposed by the Commission in its Recommendation, especially addressed to SMEs:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Under the SME Fund, a Commission initiative implemented by the EUIPO, a new service called\u00a0<strong>\u201c<\/strong><a href=\"https:\/\/www.euipo.europa.eu\/en\/discover-ip\/ideas-powered-for-business\/ip-scan\"><strong>IP scan enforcement voucher<\/strong><\/a><strong>\u201d<\/strong>\u00a0reimburses the costs incurred by SMEs that seek initial advice by experts on how to enforce their rights in case of an IP infringement or how to avoid infringing another company&#8217;s IP rights.<\/li>\n<li>A\u00a0<strong>Cybertheft Prevention Toolkit<\/strong>, providing awareness-raising materials and trainings, will be developed by the Commission. This will help SMEs prevent or react to cyber-attacks (e.g. hacking) against trade secrets.<\/li>\n<li>A checklist with\u00a0<strong>guidance on how SMEs can use AI<\/strong>\u00a0without compromising their intangible assets will be developed by the Commission in close cooperation with the industry and Member States.<\/li>\n<\/ul>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/propiedad-intelectual-e-industrial-dibujos-y-modelos-industriales\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/11\/diseno-1024x683.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/intellectual-property-industrial-design\/\" target=\"_blank\" rel=\"noopener\">Intellectual property: Industrial design<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h6 style=\"text-align: justify;\"><span style=\"font-size: 14pt;\">Next Steps<\/span><\/h6>\n<p style=\"text-align: justify;\">The Commission, together with the EUIPO, will closely monitor the effects and implementation of this Recommendation. On this basis, the Commission will assess the effects of the Recommendation within three years from the adoption. The Commission will then decide whether additional measures are needed at EU level, in view of technological developments and of the outcome of the ongoing enforcement study that the Commission is carrying out.
