{"id":149950,"date":"2024-03-15T11:59:36","date_gmt":"2024-03-15T10:59:36","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=149950"},"modified":"2024-03-15T11:59:36","modified_gmt":"2024-03-15T10:59:36","slug":"commission-initiates-formal-proceedings-against-aliexpress-under-the-digital-services-act","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/commission-initiates-formal-proceedings-against-aliexpress-under-the-digital-services-act\/","title":{"rendered":"Commission initiates formal proceedings against AliExpress under the Digital Services Act"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>The Commission has opened\u00a0formal proceedings\u00a0to assess whether AliExpress may have breached the\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/digital-services-act-package\">Digital Services Act (DSA)<\/a>\u00a0in areas linked to the management and mitigation of risks, to content moderation and the internal complaint handling mechanism, to the transparency of advertising and recommender systems, to the traceability of traders and to data access for researchers.<\/strong><\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-scaled.jpg\"><img decoding=\"async\" class=\"size-full wp-image-149947 aligncenter\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-scaled.jpg\" alt=\"\" width=\"2560\" height=\"1710\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-scaled.jpg 2560w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-300x200.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-1024x684.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-768x513.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-1536x1026.jpg 1536w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2024\/03\/cardmapr-nl-SGj4fw55Y7w-unsplash-2048x1368.jpg 2048w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">On the basis of the preliminary investigation conducted so far, including the analysis of the risk assessment report sent by AliExpress in August 2023, the information published in its Transparency report and its replies to the Commission&#8217;s formal requests for information (from\u00a0<a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/mex_23_5584\">6 November<\/a>\u00a02023 and\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/news\/commission-sends-requests-information-17-very-large-online-platforms-and-search-engines-under\">18 January<\/a>\u00a02024), the Commission has decided to open formal proceedings against AliExpress under the Digital Services Act.<\/p>\n<p style=\"text-align: justify;\">The proceedings will focus on the following areas:<\/p>\n<ul style=\"text-align: justify;\">\n<li>The compliance with the DSA obligations related to the\u00a0<strong>assessment and mitigation of the systemic risks of dissemination of illegal content<\/strong>, as well as\u00a0<strong>actual or foreseeable negative effects for<\/strong>\u00a0<strong>consumer protection<\/strong>\u00a0linked in particular to:\n<ul>\n<li>The lack of enforcement of AliExpress&#8217; terms of service prohibiting certain products posing risks for consumers&#8217; health (such as fake medicines and food as well as dietary supplements) and for minors specifically (access to pornographic material), which consumer can still find on the platform;<\/li>\n<li>The lack of effective measures to prevent dissemination of illegal content;<\/li>\n<li>The lack of effective measures to prevent intentional manipulation on the online platform through so-called \u2018hidden links&#8217;;<\/li>\n<li>The lack of effective measures to prevent risks deriving from features, such as influencers promoting illegal or harmful products through the \u201cAffiliate Programme\u201d of AliExpress.<\/li>\n<\/ul>\n<\/li>\n<li>The compliance with the DSA obligation to allow all users, including those who are not registered, to\u00a0<strong>notify illegal content<\/strong>\u00a0and to receive confirmation of the receipt of the notice;<\/li>\n<li>The compliance with the DSA obligation to provide an\u00a0<strong>effective internal complaint-handling system<\/strong>;<\/li>\n<li>The compliance with the DSA obligation to gather and assess the\u00a0<strong>reliability and completeness of the information requested from traders\u00a0<\/strong>using AliExpress including in relation to traders within the \u201cAliExpress Affiliate Program\u201d, in line with the traceability of traders&#8217; provision;<\/li>\n<li>The compliance with the DSA obligation to provide transparency on the<strong>\u00a0main parameters used in AliExpress&#8217; recommender systems<\/strong>\u00a0and to provide at least one option of recommender system\u00a0<strong>not based on profiling<\/strong>;<\/li>\n<li>The compliance with the DSA obligation to provide a<strong>\u00a0searchable and reliable repository for advertisements<\/strong>\u00a0presented on AliExpress;<\/li>\n<li>The compliance with the DSA obligation to give<strong>\u00a0researchers access to AliExpress&#8217; publicly accessible data<\/strong>\u00a0as mandated by Article 40 of the DSA.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If proven, these failures would constitute infringements of Articles 16, 20, 26, 27, 30, 34, 35, 38, 39 and 40 of the DSA. The Commission will now carry out an in-depth investigation as a matter of priority. The opening of formal proceedings does not prejudge the outcome.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/la-comision-europea-pide-informacion-a-aliexpress-en-el-marco-de-la-ley-de-servicios-digitales-por-la-venta-de-medicamentos-falsos\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2023\/11\/cardmapr-nl-SGj4fw55Y7w-unsplash-scaled.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/commission-sends-request-for-information-to-aliexpress-under-the-digital-services-act\/\" target=\"_blank\" rel=\"noopener\">Commission sends request for information to AliExpress under the Digital Services Act<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3 style=\"text-align: justify;\">Next Steps<\/h3>\n<p style=\"text-align: justify;\">After the formal opening of proceedings, the Commission will continue to gather evidence, for example by sending additional requests for information, conducting interviews or inspections.<\/p>\n<p style=\"text-align: justify;\">The opening of formal proceedings empowers the Commission to take further enforcement steps, such as interim measures ordering to terminate or remedy an infringement of Article 28(1), and non-compliance decisions. The Commission is also empowered to accept commitments made by AliExpress to remedy the matters subject to the proceeding.<\/p>\n<p style=\"text-align: justify;\">The DSA does not set any legal deadline for bringing formal proceedings to an end. The duration of an in-depth investigation depends on several factors, including the complexity of the case, the extent to which the company concerned cooperates with the Commission and the exercise of the rights of defence.<\/p>\n<p style=\"text-align: justify;\">The opening of formal proceedings relieves Digital Services Coordinators of their powers to supervise and enforce the DSA in relation to the suspected infringements of Articles 16, 20, 26, 27, 30.<\/p>\n<p style=\"text-align: justify;\">The opening of formal proceedings does not prejudge its outcome or prejudge any other proceedings that the Commission may decide to initiate under other articles of the DSA.
