Nevertheless, a number of them have to abide by many of the same\u00a0<strong>rules and restrictions<\/strong>\u00a0as an employed worker. This indicates that they are in fact in an\u00a0<strong>employment relationship<\/strong>\u00a0and should therefore enjoy the\u00a0<strong>labour rights<\/strong>\u00a0afforded to employees under national and EU law.<\/p>\n<p style=\"text-align: justify;\">The provisional agreement reached with the Parliament addresses these cases of misclassification and eases the way for such workers to be reclassified as employees. Under the agreement, workers will be <strong>legally presumed to be employees<\/strong>\u00a0of a digital platform (as opposed to self-employed) if their relationship with the platform fulfils at least\u00a0<strong>two out of five\u00a0<\/strong><strong>indicators<\/strong>\u00a0set out in the directive. These indicators include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>upper limits on the\u00a0<strong>amount of money<\/strong>\u00a0workers can receive<\/li>\n<li>supervision of their\u00a0<strong>performance<\/strong>, including by electronic means<\/li>\n<li>control over the distribution or\u00a0<strong>allocation of tasks<\/strong><\/li>\n<li>control over\u00a0<strong>working conditions<\/strong>\u00a0and restrictions on choosing working hours<\/li>\n<li>restrictions on their freedom to\u00a0<strong>organise\u00a0<\/strong>their work and rules on their appearance or conduct<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">According to the agreed text, member states may add further indicators to this list as a matter of national law.<\/p>\n<p style=\"text-align: justify;\">In cases where the legal presumption applies, it will be up to the digital platform to demonstrate that no employment relationship exists according to national law and practice.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/europa-mejora-las-condiciones-laborales-en-las-plataformas-digitales\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/12\/P039782-112696.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/europe-improves-working-conditions-on-digital-platforms\/\" target=\"_blank\" rel=\"noopener\">Europe improves working conditions on digital platforms<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h6 style=\"text-align: justify;\"><span style=\"font-size: 14pt;\">More transparent use of algorithms<\/span><\/h6>\n<p style=\"text-align: justify;\">Digital labour platforms regularly use\u00a0<strong>algorithms for human resources management<\/strong>. As a result, platform workers are often faced with a\u00a0<strong>lack of transparency<\/strong>\u00a0on how decisions are taken and how personal data is used.<\/p>\n<p style=\"text-align: justify;\">The deal reached with the Parliament ensures that\u00a0<strong>workers are informed<\/strong>\u00a0about the use of automated monitoring and decision-making systems. It also\u00a0<strong>prevents digital labour platforms<\/strong>\u00a0<strong>from processing certain kinds of personal data<\/strong>\u00a0by means of automated monitoring or decision-making systems. Such data will include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>personal data on the emotional or psychological state of platform workers<\/li>\n<li>data related to private conversations<\/li>\n<li>data to predict actual or potential trade union activity<\/li>\n<li>data used to infer a worker\u2019s racial or ethnic origin, migration status, political opinions, religious beliefs or health status<\/li>\n<li>biometric data, other than data used for authentication<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Under the new rules, these systems need to be\u00a0<strong>monitored by qualified staff<\/strong>, who enjoy special protection from adverse treatment.\u00a0<strong>Human oversight<\/strong>\u00a0is also guaranteed for significant decisions such as the suspension of accounts.<\/p>\n<h6 style=\"text-align: justify;\"><span style=\"font-size: 14pt;\">Next steps<\/span><\/h6>\n<p style=\"text-align: justify;\">The provisional agreement will now have to be endorsed by the Council and the Parliament. It will then be formally adopted by both institutions following legal-linguistic revision.
