Authorities will also be able to communicate between themselves and exchange case-related data in civil, commercial and criminal matters through secure, reliable digital channels.<\/p>\n<p style=\"text-align: justify;\">The new rules, once adopted, will improve cross-border judicial procedures by:<\/p>\n<ul style=\"text-align: justify;\">\n<li>allowing parties and other relevant persons in civil, commercial and criminal hearings to participate by means of videoconferencing or other distance communication technology<\/li>\n<li>establishing a European electronic access point through which natural and legal persons can file claims, send and receive relevant information, and communicate with the competent authorities<\/li>\n<li>accepting electronic communication and documents from natural and legal persons<\/li>\n<li>recognising documents with electronic signatures or seals<\/li>\n<li>promoting the payment of fees through electronic means<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/en\/modernising-judicial-cooperation-with-further-digitalization\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2021\/12\/guillaume-perigois-0NRkVddA2fw-unsplash-1024x683.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/modernising-judicial-cooperation-with-further-digitalization\/\" target=\"_blank\" rel=\"noopener\">Modernising judicial cooperation with further digitalization<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h4 style=\"text-align: justify;\"><\/h4>\n<p style=\"text-align: justify;\"><strong>Background and next steps<\/strong><\/p>\n<p style=\"text-align: justify;\">Currently, digital means are not always used for communication between authorities in cross-border civil, commercial and criminal cases. The reason for this is a lack of secure and reliable digital communication channels or the non-recognition of electronic documents, signatures and seals.<\/p>\n<p style=\"text-align: justify;\">In addition, in case of &#8216;force majeure&#8217; events \u2013 such as the COVID-19 pandemic \u2013 the normal functioning of member states&#8217; justice systems may also be affected. The continued functioning of the courts in such situations will require a digital tool with satisfactory security and fundamental rights standards.<\/p>\n<p style=\"text-align: justify;\">The proposed EU-laws that the Council and the European Parliament provisionally have agreed on, do not establish new European procedures. They will create the necessary legal framework to facilitate electronic communication in the context of the cross-border judicial cooperation procedures in civil, commercial and criminal matters.<\/p>\n<p style=\"text-align: justify;\">The proposals for a regulation on the digitalisation of judicial cooperation and access to justice and for an accompanying directive were adopted by the Commission on 1 December 2021.
