This regulation updates the current rules to ensure that products sold both offline and online are\u00a0<strong>safe<\/strong>\u00a0and live up to European standards.<\/p>\n<blockquote>\n<div class=\"quote_txt\">\n<p>This regulation will help to reduce the number of dangerous products sold both offline and online in the EU market, including in online marketplaces. Consumers will be better protected and will also be entitled to a refund or replacement if they have purchased an unsafe product.<\/p>\n<p><cite title=\"Jozef S\u00edkela, Czech minister for industry and trade\">Jozef S\u00edkela, Czech minister for industry and trade<\/cite><\/p>\n<\/div>\n<\/blockquote>\n<p style=\"text-align: justify;\">All products traded in the EU are subject to general safety requirements. However, to keep up with challenges linked to digitalisation and the increasing amount of goods and products sold online, the general product safety rules in force are no longer suited to addressing current digital and technological developments and challenges.<\/p>\n<p style=\"text-align: justify;\">The GPSR therefore transforms the\u00a0<strong>general product safety directive<\/strong>\u00a0from 2001 into a regulation, modernises the rules for all economic operators (manufacturers, importers and distributers) and updates them for online businesses and online marketplaces. Transforming the directive into a regulation will ensure a sound legal framework to guarantee that products are\u00a0<strong>safe<\/strong>\u00a0and follow European standards.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/entran-en-vigor-ley-de-servicios-digitales-de-la-ue-para-las-plataformas-en-linea\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/01\/digital-768x512-1.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/eus-landmark-rules-for-online-platforms-enter-into-force\/\" target=\"_blank\" rel=\"noopener\">EU\u2019s landmark rules for online platforms enter into force<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>Buying safe products online<\/h3>\n<p style=\"text-align: justify;\">The GPSR links product safety challenges to new technologies and to\u00a0<strong>online marketplaces<\/strong>. Online marketplaces will have to co-operate with market surveillance authorities if they detect a dangerous product on their platform. For that purpose, they would be required to establish a\u00a0<strong>single point of contact\u00a0<\/strong>in charge of product safety.<\/p>\n<p style=\"text-align: justify;\">Online marketplaces will have to ensure they know the traders who operate on their platforms and the products they offer. Market surveillance authorities will be able to issue orders requiring online marketplaces to remove dangerous products from their platforms or to disable access to such offers. The GPSR also creates a single market\u00a0<strong>surveillance<\/strong>\u00a0<strong>regime<\/strong>\u00a0that applies to all products.<\/p>\n<h3 style=\"text-align: justify;\">Better consumer protection<\/h3>\n<p style=\"text-align: justify;\">If a product has proven to be unsafe, economic operators are required to immediately adopt corrective measures and inform market surveillance authorities and consumers accordingly. If a product has to be recalled, consumers will be entitled to<strong>\u00a0repair, replacement\u00a0<\/strong>or a\u00a0<strong>refund.<\/strong>\u00a0When possible, economic operators have to make sure that consumers can choose from at least\u00a0<strong>two\u00a0<\/strong>of these options.<\/p>\n<h3 style=\"text-align: justify;\">Responsible person<\/h3>\n<p style=\"text-align: justify;\">The new rules ensure that economic operators have a\u00a0<strong>responsible person<\/strong>\u00a0for products sold online and offline, whether they originate from the EU or from a third country.<\/p>\n<p style=\"text-align: justify;\">The responsible person will be in charge of checking that technical documentation exists for the<strong>\u00a0products<\/strong>\u00a0<strong>that they are responsible for\u00a0<\/strong>offered by the economic operator and that products are accompanied by instructions and safety information.<\/p>\n<p style=\"text-align: justify;\">Following the formal adoption of the regulation and its entry into force, member states will have\u00a0<strong>18 months\u00a0<\/strong>to apply the new rules on general product safety.<\/p>\n<h3 style=\"text-align: justify;\">Next steps<\/h3>\n<p style=\"text-align: justify;\">The provisional agreement reached today is subject to approval by the Council and the European Parliament.<\/p>\n<p style=\"text-align: justify;\">On the Council\u2019s side, the provisional political agreement is subject to approval by member states&#8217; representatives (in Coreper) before going through the formal steps of the adoption procedure.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/ficha\/promoting-product-longevity\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2020\/08\/Promoting-product-longevity-205x300.jpg\" alt=\"\" width=\"150\" height=\"219\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/ficha\/promoting-product-longevity\/\" target=\"_blank\" rel=\"noopener\">Promoting product longevity<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>More information<\/h3>\n<p><a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2022\/11\/29\/council-and-european-parliament-agree-on-new-product-safety-rules\/\" target=\"_blank\" rel=\"noopener\">European Council<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Council and the European Parliament have reached a provisional agreement on the general product safety regulation (GPSR).
