Regulating the digital market at EU level will create a fair and competitive digital environment, allowing companies and consumers to\u00a0<strong>benefit<\/strong>\u00a0from digital opportunities.<\/p>\n<blockquote><p>With the final adoption of the Digital Markets Act, we will finally make large online platforms responsible for their actions. Hereby, the EU will change the online space worldwide. The gatekeepers that the DMA addresses are omnipresent \u2013 we all use their services on a daily basis. However, their power is growing to an extent that negatively affects competition. Thanks to the DMA, we will ensure fair competition online, more convenience for consumers and new opportunities for small businesses.<\/p>\n<p>Ivan Barto\u0161, Deputy Prime Minister for Digitisation and Minister of Regional Development<\/p><\/blockquote>\n<h2 style=\"text-align: justify;\">New rules for gatekeepers<\/h2>\n<p style=\"text-align: justify;\">The DMA defines\u00a0<strong>new rules<\/strong>\u00a0for large online platforms (\u201cgatekeepers\u201d). They now have to:<\/p>\n<ul style=\"text-align: justify;\">\n<li>ensure that unsubscribing from core platform services is just as easy as subscribing<\/li>\n<li>ensure that the basic functionalities of instant messaging services are interoperable, i.e. enable users to exchange messages, send voice messages or files across messaging apps<\/li>\n<li>give business users access to their marketing or advertising performance data on the platform<\/li>\n<li>inform the European Commission of their acquisitions and mergers<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">But they can no longer:<\/p>\n<ul style=\"text-align: justify;\">\n<li>rank their own products or services higher than those of others (self-preferencing)<\/li>\n<li>pre-install certain apps or software, or prevent users from easily un-installing these apps or software<\/li>\n<li>require the most important software (e.g.\u00a0web browsers) to be installed by default when installing an operating system<\/li>\n<li>prevent developers from using third-party payment platforms for app sales<\/li>\n<li>reuse private data collected during a service for the purposes of another service<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">If a large online platform is identified as a gatekeeper, it will have to comply with the rules of the DMA within six months.<\/p>\n<p style=\"text-align: justify;\">If a gatekeeper\u00a0<strong>violates<\/strong>\u00a0the rules laid down in the DMA, it risks a fine of up to\u00a0<strong>10%<\/strong>\u00a0of its total worldwide turnover. For a repeat offence, a fine of up to\u00a0<strong>20%<\/strong>\u00a0of its worldwide turnover may be imposed.<\/p>\n<p style=\"text-align: justify;\">If a gatekeeper\u00a0<strong>systematically<\/strong>\u00a0fails to comply with the DMA, i.e. it violates the rules at least\u00a0<strong>three<\/strong>\u00a0<strong>times<\/strong>\u00a0in\u00a0<strong>eight<\/strong>\u00a0<strong>years<\/strong>, the European Commission can open a market investigation and, if necessary, impose behavioural or structural remedies.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/en\/antitrust-commission-seeks-feedback-on-commitments-offered-by-amazon-concerning-marketplace-seller-data-and-access-to-buy-box-and-prime\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/07\/bryan-angelo-FtiXADBTqGY-unsplash-scaled.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/antitrust-commission-seeks-feedback-on-commitments-offered-by-amazon-concerning-marketplace-seller-data-and-access-to-buy-box-and-prime\/\" target=\"_blank\" rel=\"noopener\">Antitrust: Commission seeks feedback on commitments offered by Amazon concerning marketplace seller data and access to Buy Box and Prime<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\">Background<\/h2>\n<p style=\"text-align: justify;\">The EU&#8217;s legal framework for digital services had not changed since the adoption of the e-commerce directive in 2000. In the meantime, digital technologies, business models and services have changed at an\u00a0<strong>unprecedented<\/strong>\u00a0<strong>pace<\/strong>. To keep up with this pace, the European Commission presented a digital services package comprising the Digital Services Act (DSA) and the Digital Markets Act (DMA) in December 2020.<\/p>\n<p style=\"text-align: justify;\">The digital services package is the EU\u2019s response to the\u00a0<strong>need<\/strong>\u00a0<strong>to<\/strong>\u00a0<strong>regulate<\/strong>\u00a0the\u00a0<strong>digital space<\/strong>. Together, the DSA and the DMA define a framework adapted to the economic and democratic footprint of digital giants and introduce measures to protect users while supporting innovation in the digital economy.<\/p>\n<p style=\"text-align: justify;\">On 25\u00a0November 2021, less than a year after the start of negotiations in the Council, member states\u00a0<strong>unanimously<\/strong>\u00a0agreed on the Council\u2019s position on the DMA.<\/p>\n<p style=\"text-align: justify;\">On 24 March 2022, the Council and the European Parliament reached a provisional agreement on the DMA, which was endorsed by EU member states\u2019 representatives on 11 May 2022.<\/p>\n<p style=\"text-align: justify;\">The provisional agreement on the\u00a0<strong>DSA\u00a0<\/strong>that was reached by the Council and the European Parliament on 23 April 2022 and adopted in European Parliament on 5 July is expected to be adopted by the Council in\u00a0<strong>September 2022<\/strong>.<\/p>\n<h2 style=\"text-align: justify;\">Next steps<\/h2>\n<p style=\"text-align: justify;\">Following the Council\u2019s approval today of the European Parliament&#8217;s position, the legislative act was adopted.<\/p>\n<p style=\"text-align: justify;\">After being signed by the President of the European Parliament and the President of the Council, it will be published in the<em>\u00a0Official Journal of the European Union<\/em>\u00a0and will start to apply\u00a0<strong>six<\/strong>\u00a0<strong>months<\/strong>\u00a0later.<\/p>\n<h3>Source<\/h3>\n<p><a href=\"https:\/\/www.consilium.europa.eu\/es\/press\/press-releases\/2022\/07\/18\/dma-council-gives-final-approval-to-new-rules-for-fair-competition-online\/\" target=\"_blank\" rel=\"noopener\"><strong>European Council \u2014 Press release<\/strong><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 18 July, the Council gave its final approval on new rules for a fair and competitive digital sector through the Digital Markets Act\u00a0(DMA).
