{"id":110875,"date":"2022-06-21T03:00:30","date_gmt":"2022-06-21T01:00:30","guid":{"rendered":"https:\/\/www.cde.ual.es\/?p=110875"},"modified":"2022-06-21T08:42:50","modified_gmt":"2022-06-21T06:42:50","slug":"cjeu-judgment-uk-prestige-arbitration-cannot-block-spanish-ruling","status":"publish","type":"post","link":"https:\/\/www.cde.ual.es\/en\/cjeu-judgment-uk-prestige-arbitration-cannot-block-spanish-ruling\/","title":{"rendered":"CJEU Judgment: UK Prestige arbitration cannot block Spanish ruling"},"content":{"rendered":"<p style=\"text-align: justify;\">By its judgment, the Court holds that Regulation No 44\/2001 must be interpreted as meaning that a judgment entered by a court of a Member State in the terms of an arbitral award cannot prevent, in that Member State, the recognition of a judgment given in another Member State where a judicial decision resulting in an outcome equivalent to the outcome of that award could not have been adopted by a court of the first Member State without infringing the provisions and the fundamental objectives of that regulation, in particular as regards the relative effect of an arbitration clause included in the insurance contract in question and the rules on lis pendens.<\/p>\n<p><a href=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige.jpg\"><img decoding=\"async\" class=\"aligncenter wp-image-110868 size-large\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige-1024x685.jpg\" alt=\"Sentencia TJUE: el arbitraje en Reino Unido por el Prestige no puede bloquear la sentencia espa\u00f1ola\" width=\"1024\" height=\"685\" srcset=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige-1024x685.jpg 1024w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige-300x201.jpg 300w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige-768x514.jpg 768w, https:\/\/www.cde.ual.es\/wp-content\/uploads\/2022\/06\/Prestige.jpg 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">In doing so, the Court ensures, in essence, that those provisions and fundamental objectives cannot be circumvented by means of arbitration proceedings followed by judicial proceedings seeking to have the terms of the arbitral award entered in a judicial decision.<\/p>\n<p style=\"text-align: justify;\">As a preliminary point, the Court notes that the regulation excludes arbitration from its scope. A judgment entered in the terms of an arbitral award is therefore caught by that arbitration exclusion and cannot enjoy mutual\u00a0recognition between the Member States.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/en\/cjeu-online-traders-must-provide-information-about-the-product-guarantee\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2018\/04\/Tribunal-Justicia-Union-Europea.jpg\" alt=\"\" width=\"166\" height=\"93\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/cjeu-online-traders-must-provide-information-about-the-product-guarantee\/\" target=\"_blank\" rel=\"noopener\">CJEU: Online traders must provide information about the product guarantee<\/a><\/h4>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"text-align: justify;\">That being said, such a judgment may be regarded as a judgment within the meaning of Article 34of the regulation alone, capable of preventing the recognition of judgments from other Member States if those judgments are irreconcilable.<\/p>\n<p style=\"text-align: justify;\">However, the position is different where the arbitral award in the terms of which that judgment was entered was, as in the present case, made in circumstances which would not have permitted the adoption, in compliance with the provisions and fundamental objectives of that regulation, of a judicial decision falling within the scope of that regulation.<\/p>\n<p style=\"text-align: justify;\">As regards the relative effect of an arbitration clause included in an insurance contract, the Court notes that a jurisdiction clause agreed between an insurer and an insured party cannot be invoked against a victim of insured damage who, where permitted by national law, wishes to bring an action directly against the insurer, in tort, delict or quasi-delict, before the courts for the place where the harmful event occurred or before the courts for the place where the victim is domiciled.
