It is to avoid duplication and in the interest of the defense that the EPPO regulation establishes a priority competence for the EPPO to investigate all the facts linked to a possible fraud affecting the financial interests of the European Union.<\/p>\n<p>In this context, given our unprecedented nature and the complex interaction between national and European laws under which we operate, the EPPO would like to recall that in a situation of conflict of competence, a referral to the European Court of Justice should always be considered.<\/p>\n<table style=\"width: 99.9988%; border-collapse: collapse; border-style: double; border-color: #001f7d;\" cellpadding=\"0,5\">\n<tbody>\n<tr>\n<td style=\"width: 100%;\"><a href=\"https:\/\/www.cde.ual.es\/en\/laura-kovesi-confirmed-as-european-chief-prosecutor\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/www.cde.ual.es\/wp-content\/uploads\/2019\/10\/FISCAL-EUROPEA.jpg\" alt=\"\" width=\"201\" height=\"134\" \/><\/a><\/p>\n<h4 class=\"entry-title\"><a href=\"https:\/\/www.cde.ual.es\/en\/laura-kovesi-confirmed-as-european-chief-prosecutor\/\" target=\"_blank\" rel=\"noopener\">Laura K\u00f6vesi confirmed as European Chief Prosecutor<\/a><\/h4>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>The European Public Prosecutor\u2019s Office (EPPO) has taken note of the decision of 28 March 2022 by the Fiscal General del Estado to divide the competence over the same facts between the Fiscalia Anticorrupcion and the EPPO. The EPPO is of the view that this decision is not in line with EU law and will continue its investigation.<\/p>\n<p>Specifically, the decision on a conflict of competence between a national body and a European body has been taken by the Fiscal General del Estado who is the hierarchical superior of the national body and thus partial to the ongoing proceedings.
